Overview

Welcome to Kathwool. Kathwool is a brand operated by StarSpace International LIMITED. The terms “Kathwool,” “we,” “us,” and “our” refer to StarSpace International LIMITED, trading as Kathwool.

Kathwool operates this store and website, including the related information, content, features, tools, products, and services offered to provide customers with a curated shopping experience (collectively, the “Services”). The Services are powered by Shopify, which enables us to provide the online store and related functionality.

These Terms of Service, together with all policies referenced in them, describe your rights and responsibilities when you visit, interact with, or use the Services. By accessing or using the Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not access or use the Services.

1. Eligibility, Access, and Accounts

By using the Services, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, or that you have the consent of a parent or legal guardian to use the Services.

You agree to provide accurate, current, and complete information when creating an account, placing an order, subscribing to communications, or otherwise using the Services. You are responsible for maintaining the security of your account credentials and for activities carried out through your account. You may not transfer, sell, assign, or license your account to another person.

2. Products and Handmade Variations

We make reasonable efforts to display and describe our products accurately. Product colors and appearance may vary because of screen settings, lighting, photography, material batches, and other factors.

Many Kathwool products are handmade or arranged by hand. Small variations in stitching, shape, size, positioning, texture, or color are part of their handmade character and do not constitute a defect when the item remains materially consistent with its product description and photographs.

Product descriptions, availability, specifications, prices, and designs may be changed without notice. We may discontinue products or limit quantities available to any person, address, geographic region, or jurisdiction.

3. Orders and Order Acceptance

Submitting an order is an offer to purchase. An order is not accepted until we confirm acceptance and successfully process the applicable payment. We may reject, limit, hold, or cancel an order when reasonably necessary, including because of inventory errors, pricing errors, suspected fraud, payment problems, shipping restrictions, or suspected unauthorized resale.

Please review your order carefully before submitting it. Changes and cancellations are not guaranteed after an order enters processing. Handmade, customized, personalized, and made-to-order products may not be cancellable after production begins.

Retail purchases are intended for personal or household use. Approved wholesale or business purchases are permitted when made through a Kathwool wholesale account, quotation, purchase order, or other written agreement. Separate wholesale terms may apply and will control if they conflict with these Terms.

Returns and refunds are governed by our Return & Refund Policy.

4. Prices, Currency, Taxes, and Billing

Prices, discounts, and promotions may change without notice. Unless otherwise stated, prices are displayed and charged in United States dollars (USD). The price applicable to an order is the price shown at checkout when the order is submitted.

Unless expressly stated, displayed prices do not include shipping charges, import duties, customs charges, brokerage fees, or applicable taxes. Those amounts may be calculated at checkout or assessed by the destination authorities.

You represent that the billing and payment information you submit is accurate, that you are authorized to use the selected payment method, and that the payment provider will honor the charges associated with your order.

5. Shipping and Delivery

Kathwool currently ships from China to eligible addresses in the United States and Canada. Processing and delivery times are estimates and are not guaranteed. Customs processing, carrier delays, severe weather, public holidays, remote locations, and events outside our reasonable control may affect delivery.

Title and risk of loss pass to you when the order is delivered to the delivery address, except where applicable law provides otherwise. Claims involving delayed, lost, damaged, missing, or incorrectly delivered orders are handled under our Shipping Policy.

6. Digital Crochet Patterns and Tutorials

Unless a product page expressly states otherwise, digital crochet patterns, tutorials, charts, photographs, videos, and downloadable materials are licensed, not sold. Kathwool retains all intellectual property rights in those materials.

You receive a limited, revocable, non-exclusive, non-transferable license to download and use purchased or freely provided patterns and tutorials for personal use. You may not copy, reproduce, translate, upload, distribute, share, sublicense, sell, republish, or otherwise make any pattern or tutorial available to another person, whether in its original form or a modified form.

Independent makers may sell finished physical items personally made from a Kathwool pattern in small quantities, provided that the listing or display credits “Pattern by Kathwool.” This permission does not authorize factory production, mass production, print-on-demand use, resale of kits as your own design, or use of the pattern by employees, contractors, manufacturers, or other third parties without our prior written permission.

Digital products cannot be returned after delivery or access, except where applicable law requires otherwise. Refer to our Return & Refund Policy.

7. Intellectual Property

The Services and their content—including trademarks, logos, brand names, text, product names, patterns, tutorials, photographs, graphics, video, audio, reviews, and the design and arrangement of the website—are owned by Kathwool, its affiliates, or its licensors and are protected by applicable intellectual property laws and international treaties.

Except for the limited permissions expressly granted in these Terms, you may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, transmit, scrape, or commercially exploit any part of the Services without prior written permission. All rights not expressly granted are reserved.

8. Optional Tools and Third-Party Services

The Services may provide access to tools, integrations, payment methods, social features, or other functionality supplied by third parties. Such tools are provided “as is” and “as available.” Your use of third-party tools is at your own discretion and may be subject to the third party’s own terms and privacy policy.

We may introduce new features, tools, or resources in the future. Unless separate terms are provided, those additions form part of the Services and are governed by these Terms.

9. Third-Party Links

The Services may contain links to websites or resources operated by third parties. We are not responsible for examining or guaranteeing their content, accuracy, security, availability, products, or practices. Accessing a third-party website is at your own risk. Questions regarding third-party products or services should be directed to the relevant third party.

10. Relationship with Shopify

Kathwool is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are transactions directly between you and Kathwool. Shopify is not responsible for any aspect of a sale between you and Kathwool, including injury, damage, or loss arising from products or services purchased from Kathwool. To the extent permitted by law, you release Shopify and its affiliates from claims arising directly from your purchases and transactions with Kathwool.

11. Privacy

Personal information collected through the Services is handled according to our Privacy Policy. Certain personal information is also processed by Shopify according to the Shopify Consumer Privacy Policy.

12. Feedback, Reviews, and User Content

If you submit reviews, photographs, comments, suggestions, ideas, or other content (“Feedback”), you grant Kathwool a worldwide, perpetual, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, translate, and display that Feedback for operating, improving, and promoting the Services.

You represent that you own or control the necessary rights to the Feedback, that it is accurate, that any compensation or incentive has been disclosed, and that it does not violate law, intellectual property, privacy, publicity, or other rights. We may remove Feedback that we reasonably consider unlawful, misleading, abusive, obscene, infringing, or otherwise inappropriate.

13. Errors, Inaccuracies, and Omissions

Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions concerning product descriptions, prices, promotions, shipping charges, transit times, or availability. We may correct errors, update information, or cancel an affected order when reasonably necessary. If a paid order is cancelled, the applicable payment will be refunded.

14. Prohibited Uses

You may use the Services only for lawful purposes. You must not use the Services to violate law; infringe intellectual property or other rights; harass, harm, defame, or impersonate another person; submit false or misleading information; transmit malware; send spam or unauthorized promotions; collect personal information without authorization; interfere with the security or operation of the Services; bypass access restrictions; or copy, scrape, resell, or exploit the Services without permission.

We may suspend or terminate access if we reasonably determine that you have violated these Terms or created risk for Kathwool, Shopify, our service providers, or other users.

15. Automated Agents

An autonomous or semi-autonomous software agent may access the Services only when permitted by us and when it accurately identifies itself, complies with applicable technical requirements, respects robots and access controls, does not misrepresent itself as human, and does not bypass CAPTCHAs or other security measures. We may technically limit or block automated access at any time.

16. Termination

We may suspend or terminate your account or access to the Services when you breach these Terms, misuse the Services, fail to pay amounts due, or create legal, security, or operational risk. Provisions that by their nature should survive termination—including intellectual property, digital licenses, disclaimers, limitations of liability, indemnification, governing law, and privacy—will remain effective.

17. Disclaimer of Warranties

Except as expressly stated by Kathwool or required by applicable law, the Services and products are provided “as is” and “as available,” without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, durability, title, or non-infringement. We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent permitted by law. Nothing in these Terms limits mandatory consumer rights.

18. Limitation of Liability

To the fullest extent permitted by law, Kathwool, StarSpace International LIMITED, Shopify, and their respective affiliates, officers, employees, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, punitive, special, or consequential damages, including lost profits, lost revenue, lost savings, loss of data, or replacement costs, arising from the Services or products.

Where liability cannot legally be excluded, our aggregate liability arising from an order will not exceed the amount you paid for the product giving rise to the claim, except where applicable law requires a greater remedy.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Kathwool, StarSpace International LIMITED, Shopify, and their respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, damages, and reasonable legal fees arising from your breach of these Terms, violation of law or third-party rights, or misuse of the Services.

20. Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted and the unenforceable portion will be severed. The remaining provisions will remain effective.

21. Waiver and Entire Agreement

Our failure to enforce any provision is not a waiver of that provision. These Terms and the policies referenced in them constitute the entire agreement governing your use of the Services, except for any separate written wholesale, promotional, subscription, or other agreement that expressly applies.

22. Assignment

You may not assign or transfer these Terms or your rights or obligations without our prior written consent. We may assign or transfer our rights and obligations in connection with a reorganization, merger, acquisition, sale of assets, or other lawful business transaction.

23. Governing Law and Jurisdiction

These Terms and any separate agreement through which we provide the Services are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles. Subject to any mandatory consumer rights or jurisdictional protections that apply to you, the courts of the Hong Kong Special Administrative Region will have exclusive jurisdiction over disputes arising from these Terms or the Services.

24. Changes to These Terms

We may update these Terms from time to time for operational, legal, or regulatory reasons. The current version will be posted on this page with a revised “Last updated” date. Material changes will be communicated when required by applicable law. Continued use of the Services after an update takes effect constitutes acceptance of the revised Terms.
